General Terms and Conditions

Prices of programs and services

  • All FIT programs are tailor-made and quoted according to the traveler’s requirements.
  • All rates are NET of commission, per person, in American Dollars (USD) and based on a full-service program that includes accommodation, excursions, transfers, and all necessary entrance fees according to the itinerary.
  • All quoted rates are based on the number of guests indicated at the time of the request. If there is a reduction or increase in the number of guests, please consider that Peru LEGACY Co. will review the quotation, and the final rate will change.
  • Peru LEGACY Co. is not required to break down the costs of the quoted program.
  • All foreign visitors visiting Peru for no more than 60 days are exempt from 18% IGV (General Sales Tax) on lodging and food in the hotels where they stay. Our rates already consider the exoneration of the IGV.
  • Rates do not apply to national holidays, long weekends, or dates of special events unless explicitly indicated in the quote. Please ask your Travel Advisor for rates and availability for special dates such as Easter, Inti Raymi, National Holidays, Christmas, New Year's Eve, Candelaria Festival, EXTEMIN Arequipa, and CADE Paracas, among others.
  • Confirmation of accommodation and services are subject to availability until the time of the booking.
  • Confirmation of specific tickets, such as Machu Picchu, Huayna Picchu, Machu Picchu Mountain, and Inca Trail, are subject to availability until purchase. A prepayment is required to guarantee ticket purchase (check Payment Policies).
  • The final rate of the quoted program is subject to fluctuation until the final confirmation. For the same reason, Peru LEGACY Co. reserves the right to increase or decrease the rate as the case may be, which your Travel Advisor will explain promptly and with the necessary detail.
  • In the event of significant rate changes due to inflation, political circumstances, or government and tourist regulations, Peru LEGACY Co. undertakes to promptly inform its partner's travel agencies and/or tour operators and update the rates previously offered. Likewise, it guarantees to provide alternative solutions to avoid additional expenses as far as possible without harming the quoted program.
  • Some hotels may apply a corporate rate for stays longer than three nights.

Booking requirements and necessary information

  • Booking requirements and necessary information:
    • Full name and surname of each guest (as it appears in the passport).
    • Copy of passport or identity card with which the guest(s) will enter Peru (the Identity Card only applies to residents of South American countries with an identity agreement transit with our country). These documents must be a minimum of six months old and valid when entering the country.
    • Birthdate.
    • Nationality.
    • Information on international and national flights with the airline's locator code.
    • Indicate the type of accommodation: single, double, double twin, or triple.
    • Particular indications: dietary restrictions, allergies, special celebrations, etc.
    • The guest is responsible for indicating their correct personal data to avoid inconveniences with reserving services, accommodation, ticket issuance, and purchase.
  • The bookings are only confirmed once a written communication has been sent by Peru LEGACY Co., including the confirmation status of all services, final itinerary, and payment policies. IMPORTANT: Vouchers will not be sent virtually to the partner travel agency and/or tour operator. Peru LEGACY Co. will be sending the vouchers to the suppliers involved in the program only and if necessary.
  • Once receiving the confirmation by e-mail, the travel agency and/or tour operator has at most 72 hours to notice any discrepancies. Peru LEGACY Co. assumes conformity on the travel agency and/or tour operator's part if they have not taken any action during that period, or the guest has already begun utilizing the contracted services.

Payment Policy

  • To confirm the reservation, Peru LEGACY Co. requires an advanced payment of 30% of the entire quoted program, as well as any prepayment requested by other providers to guarantee the service, for example, cruises in the Amazon, Inca Trail, tickets to Machu Picchu, Huayna Picchu, Machu Picchu Mountain, specialized guides, among others.
  • It is necessary to consider that some prepayments are not refundable and will be informed by your Travel Advisor.
  • The travel agency/tour operator is responsible for paying the contracted services within the terms established by Peru LEGACY Co., which your Travel Advisor will detail. If they are not met, the company reserves the right to cancel the booking, and the program will be subject to availability.
  • The travel agency/tour operator and the final guest accept all the Terms and Conditions exposed by Peru LEGACY Co. when making the first payment to the company.

Payment Methods

  • The payment must be made to Peru LEGACY Co. via bank transfer or credit card through the NIUBIZ platform. Peru LEGACY Co. will assume the Peruvian bank charges. The travel agency/tour operator must bear all bank transfer costs, taxes from the country of origin, and intermediary bank expenses.
  • All transactions on the NIUBIZ platform must be carried out personally by the travel agency/tour operator. Peru LEGACY Co. will not request a credit card copy.
  • If the travel agency/tour operator makes the payment with a currency other than the one quoted (American Dollars), they must assume the difference due to the exchange rate.

Cancellation and Rescheduling Policy

  • All cancellations must be communicated via email to the Travel Advisor.
  • Any cancellation made before the final payment deadline does not imply any penalty.
  • Any cancellation made after the final deadline indicated by your Travel Advisor is subject to the applicable penalties according to the cancellation policies of each provider, administrative expenses, and the service fee of Peru LEGACY Co. ($250.00 per person).
  • In case of receiving any cancellation outside office hours (Monday to Friday from 8:00 am to 6:00 pm, Peruvian time), the travel agency/tour operator must inform its Travel Advisor via e-mail and also by telephone – the telephone numbers are detailed on the website.
  • All reservations for services and accommodation are personal and non-transferable, non-endorsable, and non-refundable.
  • In case of cancellation due to force majeure, such as illness or death of a family member, the travel agency/tour operator must immediately contact its Travel Advisor to verify the continuity of the trip and/or review the cancellation policies.
  • Any changes or rescheduling (before the final deadline) will be subject to availability, and the rate will be reviewed by your Travel Advisor considering the new travel date.
  • In the case of applying for a refund, all transactions will be made between Peru LEGACY Co. and the travel agency/tour operator, and the final guest will not be involved. The travel agency/tour operator will assume banking and administrative expenses.
  • If the guest decides not to take any contracted services, it will not be refundable.
  • Some tours are subject to climatic factors, such as the excursion to the Ballestas Islands and Palomino Islands, the hike to Huayna Picchu, and the overflight to the Nazca Lines. If interference exists from the weather to perform any contracted service, cancellations will apply according to each provider’s services.
  • Any cancellation or change of domestic and international flights, penalties, and rate differences apply according to each airline's policies and administrative expenses of Peru LEGACY Co.

Privacy Policy

  • Peru LEGACY Co. is responsible for handling the personal information of each guest. We commit and guarantee that personal data is used correctly and is shared with providers only for the necessary purposes in the reservation process and operation of the contracted services.
  • Peru LEGACY Co. will request exclusive permission from all parties to share partner travel agencies/tour operators or guests' information on its website and/or social media accounts.
  • All intellectual property rights of this website and our programs belong to Peru LEGACY Co. The company does not permit the copying, publication, or other use of these materials without their written permission.

Formalities - Travel Operation

  • It is the responsibility of the guest to show up for the tours and transfers at the time indicated by the Tour Representative of Peru LEGACY Co. There is no responsibility on the part of the company if the guest loses any service due to issues beyond our control, such as delays, etc. In case of rescheduling or delay, it implies additional expenses that the client will assume.
  • If the guest decides not to continue or modify the tour during the trip, there will be no refund for any of the services not taken.
  • If any inconvenience arises during the operation, it is essential that the guest immediately notify the Tour Representative of Peru LEGACY Co. to help him solve the problem and take the necessary immediate actions.
  • Peru LEGACY Co. works with the best professionals in each destination. Therefore during the tour operation, we ask our guests to follow their indications and recommendations to optimize the travel program.

Responsibility

  • The guest is responsible for indicating their correct personal data to avoid inconveniences with reserving services, accommodation, ticket issuance, and purchase. Peru LEGACY Co. is not responsible for the late acquisition of tickets, reservations, or permits issued with incorrect information.
  • For trips with minors, the parents or guardians will be solely responsible for the well-being and good conduct of the child during the trip.
  • The guests agree to take care of and not violate the private property of third parties (hotels, restaurants, transport units, museums, and stores, among others).
  • Peru LEGACY Co. opposes any act of discrimination according to Law No. 28867 - Article 323: "Whoever, by himself or through third parties, discriminates against one or more people or group of people, or publicly incites or promotes discriminatory acts, based on race, religion, sexuality, genetic factors, affiliation, age, disability, language, ethnic and cultural identity, clothing, political opinion or of any kind, or economic condition, to nullify or impair the recognition, enjoyment or exercise of the rights of the person, will be punished with imprisonment of not less than two years, nor more than three or with the provision of services to the community of sixty to one hundred and twenty days.".
  • Clients accept that any act that violates Peruvian heritage will be sanctioned following the General Law of Cultural Heritage of the Nation No. 28296: "The assets that are part of the Cultural Heritage of the Nation, regardless of their private or public condition, are protected by the State and subject to the specific regime regulated in this Law.".
  • Peru LEGACY Co. guarantees the operation of the contracted services as detailed in the itinerary.
  • In case Peru LEGACY Co. does not provide any contracted service due to force majeure or other reasons, the company assumes full responsibility and will do its best to provide immediate alternative solutions of equal or greater value.
  • Peru LEGACY Co. works hand in hand with companies that provide services. In the event that service providers cease to operate due to force majeure or other reasons, Peru LEGACY Co. will request reimbursement for the contracted services and, in turn, will do its best to provide immediate alternative solutions of equal or greater value.
  • Clients accept that Peru LEGACY Co. has no responsibility for the non-provision of services in case of adverse weather conditions or natural disasters that cannot be foreseen; likewise, in the event of strikes, political demonstrations, border closures, accidents, or other reasons that are beyond the control of the company.
  • In such cases, Peru LEGACY Co. reserves the right to reschedule the activities based on the operability of the itinerary and the safety of the guests, as well as the corresponding refunds, if applicable, which will be under the cancellation and rescheduling policies of each provider.
  • Clients accept that Peru LEGACY Co. has no obligation or responsibility in case of loss or theft of objects during the excursions. We work with the best vendors in the industry, and our representatives will provide guests with all security information throughout the trip.
  • Peru LEGACY Co. guarantees to timely inform its partner travel agencies/tour operators about travel warnings to the country or certain specific cities for reasons unrelated to the company's operation, be it political or social crisis, extreme weather phenomena, or others. If the guest still decides to continue with the trip, despite the warnings made, Peru LEGACY Co. will not be responsible for operating the services to safeguard its staff; therefore, the guest assumes all responsibility for the risks.
  • Clients accept that to practice adventure sports, it is necessary to have previous experience or a specific physical condition, as well as optimal health conditions, depending on the difficulty level of said practice or sport. For this reason, they exclude Peru LEGACY Co. from responsibility for any incident that may occur and guests are responsible for all risks associated to such activities.
  • Clients accept that obtaining visas (if required) and validating the necessary documentation before starting the trip is their responsibility. All guests are advised to validate their local authority's requirements to enter Peru.
  • Peru LEGACY Co. reserves the right to correct any errors or omissions in its published materials and modify the Terms and Conditions at any time due to important changes within the company's internal regulations.
  • Peru LEGACY Co. is not responsible for the content of the websites that are referred to through hyperlinks in the quotes or other references included on the websites and social networks. Products or services offered by third parties will be subject to the terms and conditions of such parties.

IGV Tax exemption for foreign visitors

  • All foreign visitors visiting Peru for no more than 60 days are exempt from 18% IGV (General Sales Tax) on lodging and food in the hotels where they stay. To be exempt from the IGV, the guest needs to present the passport or identity card with the entry stamp and the Andean Migration Card that will be filled out electronically by the immigration authorities upon arrival in Peru. These requirements are essential at the time of check-in. Otherwise, the hotel will charge this tax directly to the guest.

Insurance

  • Peru LEGACY Co. programs do not include international medical and trip cancellation insurance. For this reason, we recommend taking both insurances before starting the journey since Peru LEGACY Co. is not responsible for assuming medical expenses or other expenses that derive from this situation.

Health Regulation

  • Currently, the country has no restrictions regarding COVID-19.
  • In case of presenting symptoms of any illness or discomfort during the trip, please notify the Tour Representative of Peru LEGACY Co. to support you in case you require medical assistance.

Miscellaneous

  • General Terms and Conditions are subject to change. In case of significant changes, your Travel Advisor will inform you on time.
  • All intellectual property rights to the content of this website and our programs belong to Peru LEGACY Co. The company does not permit the copying, publication, or other use of these materials without their written permission.
